Important: These Terms govern bookings for (a) packages/land arrangements sold by us as principal tour operator, and (b) flights/standalone services where we act as agent for the relevant supplier or ATOL holder. The role for your booking is shown on your Confirmation Invoice

1. Definitions

  • “We/us/our”: Ngasini Travel.
  • “You/your”: Lead traveller and all persons on the booking.
  • “Package”: As defined by the Package Travel and Linked Travel Arrangements Regulations 2018 (“PTRs”).
  • “Supplier”: Third party providing services (e.g., airline, hotel, ground handler).
  • “Force Majeure”: Events beyond a party’s control (e.g., natural disasters, epidemics, strikes, airspace closures, significant political unrest).

2. Our Role: Principal vs Agent

  • As principal (land arrangements/packages): Your contract is with us. We are responsible for providing the services described in your Confirmation Invoice subject to these Terms and the PTRs.
  • As agent (e.g., flights or standalone services): We arrange services with a Supplier/ATOL holder on your behalf. Your contract is with that Supplier; their terms apply in addition to ours. We are not responsible for the performance of Supplier services we do not sell as principal.

3. Booking Process & Contract

  • A contract comes into existence when we issue a Confirmation Invoice. The lead traveller must be 18+ and has authority of all travellers.
  • Name accuracy: Names must match passports. Fees for changes/errors may apply.
  • Special requests & medical needs: Tell us in writing at booking; we’ll pass requests to Suppliers but cannot guarantee them unless confirmed in writing.

4. Price, Deposit, and Balance

  • The deposit amount and balance due date are shown on your invoice. If the balance is not received on time, we may cancel and retain the deposit and any irrecoverable costs.
  • Prices may change due to taxes, fees, exchange rates, or Supplier surcharges. For Packages, any permitted surcharges and your rights are as per the PTRs.

5. Financial Protection

  • For Packages we sell as principal, your payments are protected by [ATOL number/trust account/insurance policy details]. Full details are stated on your Confirmation Invoice.
  • For flights sold as agent, protection is provided by the Supplier/ATOL holder used for your booking (even if not named on your invoice).

6. Changes & Cancellations by You

  • Requests must be in writing by the lead traveller. We’ll confirm applicable amendment feesSupplier charges, and non-refundable elements before proceeding.
  • Cancellation charges typically increase as the departure date approaches and may be up to 100%. Certain services (e.g., flights, permits, some lodges) may be fully non-refundable from booking.
  • Travel insurance should cover cancellation, curtailment, medical, and (where relevant) adventure activities.

7. Changes & Cancellations by Us/Suppliers

  • We and/or Suppliers may make necessary changes. Significant changes (e.g., major itinerary change, downgrade, or significant timing change) for Packages trigger your PTR rights (accept change, alternative, or refund as applicable). Compensation may be payable where required by law.
  • We are not liable for minor changes or for events beyond our control (Force Majeure).

8. Your Responsibilities (Passports, Visas, Health)

  • You must ensure valid passports, visas, vaccinations, and compliance with entry/health rules (including any yellow fever or other requirements). We provide general guidance only.
  • For treks/safaris/adventures, you confirm fitness to participate, agree to follow guide/safety instructions, and disclose relevant medical conditions.

9. Activities & Adventure Travel

Wildlife encounters, treks (e.g., Kilimanjaro), boat trips, and similar activities carry inherent risks. You accept such risks and agree to comply with local operator instructions. Some activities have age/weight/health restrictions.

10. Behaviour

We and Suppliers may refuse carriage or terminate services if behaviour is unsafe, illegal, or seriously disruptive. No refunds in such circumstances; you will be responsible for related costs.

11. If You Have a Complaint

  • Tell the relevant Supplier/our local partner immediately so they can put things right. If unresolved, contact us during travel at info@ngasinitravel.com.
  • After travel, email within 28 days with booking reference and evidence. This helps us investigate promptly.

12. Our Liability

  • Principal bookings: We are liable for proper performance of the Package under the PTRs. Our liability is limited as permitted by law and relevant international conventions (e.g., Montreal, Athens).
  • Agent bookings: Our duty is to exercise reasonable skill and care in arranging your booking. We are not responsible for the actual performance of Supplier services we sell as agent.
  • We do not exclude/limit liability for death or personal injury caused by our negligence or for fraud.

13. Flights (When Arranged as Agent)

  • Flight timings/routes/aircraft may change. Your contract is with the airline/ATOL holder; their conditions of carriage apply. Check-in and entry rules are your responsibility.
  • If a flight is cancelled or delayed, your EU/UK 261 rights (if applicable) are against the operating airline.

14. Force Majeure

Neither party is liable for unavoidable and extraordinary circumstances beyond their control. If such events significantly affect your Package, the PTRs set out your rights (e.g., refund where applicable, but not compensation).

15. Data Protection

  • We process personal data as a controller to manage your booking and meet legal duties. We share data with Suppliers where necessary (including transfers outside the UK/EEA where appropriate safeguards apply). See our Privacy Policy for details and your rights.
  • Emergency contacts and health information will only be used where necessary for your vital interests and to deliver requested services.

16. Insurance

Adequate travel insurance is mandatory for all travellers, including cover for medical, repatriation, cancellation/curtailment, baggage, and any planned adventure activities (e.g., high altitude trekking). We may request proof before travel.

17. Financial Conditions & Errors

We reserve the right to correct pricing/description errors. Obvious errors may be cancelled with a full refund if discovered before travel.

18. Children & Minors

Bookings including minors must have an adult responsible for them at all times and comply with any consent/guardianship requirements and Supplier rules.

19. Law & Jurisdiction

These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protections require otherwise.

Agent-Only / Independent Travel Planner Appendix

When we act purely as an agent or independent travel planner (for example, when arranging flights or a standalone service):

  1. We act on your instructions to source, quote, and book travel services with approved Suppliers or ATOL holders.
  2. Your contract is with the Supplier and subject to their own terms and conditions, which will be provided or linked where possible.
  3. All bookings are offered and confirmed at an inclusive total price, reflecting the full cost of the travel arrangements as quoted. We do not provide a breakdown of individual components or supplier costs.
  4. Any changes or cancellations are governed by the Supplier’s rules and charges. Our own reasonable administrative fees may apply in addition.
  5. Any financial protection (for example, ATOL protection for flights) is provided through the relevant Supplier or ATOL holder used for your booking. The Supplier may not be named on your documentation, but protection will remain in place through their licence.
